These Terms of Service (“Terms”) govern your access to and use of HorizenTek's website and services, including our AI voice receptionist, outbound calling agent, and related website/booking services (collectively, the “Services”). By using our website or engaging our Services, you agree to these Terms.

Description of Services

HorizenTek provides AI-powered voice agents for inbound call answering and outbound quote follow-up, primarily for landscaping, HVAC, and electrical service businesses, along with related website and booking infrastructure. Specific features, configurations, and service levels may vary by plan and will be confirmed during onboarding.

Free Trial

We may offer a free trial period for new clients. Trial terms, including duration and scope (such as a set number of days or a maximum number of outbound calls, whichever occurs first), will be communicated at the time the trial begins. No payment is required to begin a trial. If you choose to continue using the Services after the trial period ends, applicable setup fees and monthly subscription fees will apply, as described in the next section.

Fees and Payment

  • A one-time setup fee applies upon conversion from a free trial to a paid plan, used to configure and tune your AI agent(s) to your business's specific call flows.
  • Ongoing services are billed on a monthly subscription basis, at the rate applicable to the plan you select.
  • Fees are billed in advance and are non-refundable except as required by law or as otherwise agreed to in writing by HorizenTek.
  • We reserve the right to change our pricing with reasonable advance notice to active clients.

Client Responsibilities

To deliver our Services effectively, clients agree to:

  • Provide accurate information about their business, call scripts, FAQs, pricing, and service offerings during onboarding
  • Promptly notify HorizenTek of any changes that affect how calls should be handled
  • Use the Services in compliance with applicable laws, including laws related to call recording and consumer communication

Call Recording

Our Services may involve recording and transcribing calls handled by our AI voice agents for the purposes of service delivery, quality assurance, and improvement. Clients are responsible for ensuring their own compliance with applicable call recording and consent laws in the jurisdictions in which they operate, including obtaining any consent required from their customers.

Service Availability

We aim to provide reliable service but do not guarantee that the Services will be uninterrupted, error-free, or available at all times. AI-generated responses may not be accurate or appropriate in every situation. Clients should review call outcomes regularly, particularly during onboarding and trial periods.

Limitation of Liability

To the fullest extent permitted by law, HorizenTek will not be liable for any indirect, incidental, special, or consequential damages, including lost business, lost revenue, or missed appointments, arising from use of the Services. Our total liability for any claim relating to the Services will not exceed the amount paid by the client to HorizenTek in the three (3) months preceding the claim.

Cancellation

Clients may cancel their subscription at any time, subject to the notice terms communicated at signup or onboarding. Setup fees are non-refundable. Monthly fees already paid are non-refundable except as otherwise agreed.

Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes are posted constitutes acceptance of the updated Terms.
